Sagan’s Wares, LLC (“we,” “our,” or “us”) operates the website saganswares.com (the “Site”). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you visit our Site, make a purchase, use our Proffer (make-an-offer) feature, participate in Dingo’s Den marketplace, or interact with us in any capacity. By using our Site, you consent to the practices described herein.

 
1. Information We Collect

1.1 Information You Provide Directly. When you create an account, place an order, submit a Proffer offer, register as a Dingo’s Den seller, or contact us, we may collect: your full name, email address, phone number, billing and shipping address, payment information (processed by Wix Payments and/or PayPal—we do not store full card numbers), order history, Proffer offer amounts, and Dingo’s Den seller profile data (store name, tax ID if applicable, payout preferences).

1.2 Information Collected Automatically. When you access our Site, we automatically collect: IP address and approximate geolocation, browser type and version, device identifiers, operating system, referring URL, pages visited and time spent on pages, click-stream data, and cookies and similar tracking technologies (see Section 5).

1.3 Information from Third Parties. We may receive information from payment processors (Wix Payments, PayPal), shipping carriers (USPS), tax calculation services (Avalara), and analytics providers.​​​​

2. How We Use Your Information

We use the information we collect for the following purposes:

  • Processing and fulfilling orders, including shipping, tax calculation, and payment processing.

  • Operating the Proffer system (evaluating offers, auto-accepting qualifying amounts, communicating acceptance or counter-offers).

  • Administering Dingo’s Den marketplace (seller verification, commission calculation, dispute resolution).

  • Providing customer support and responding to inquiries sent to info@saganswares.com.

  • Sending transactional emails (order confirmations, shipping updates, offer status notifications).

  • Determining eligibility for free local pickup within 10 miles of Houston, TX 77057 based on your shipping address.

  • Calculating and applying location-based animal rescue donation links.

  • Improving our Site, products, and services through analytics and usage trends.

  • Complying with legal obligations and preventing fraud.

3. How We Share Your Information

We do not sell your personal information. We may share information with:

  • Payment Processors: Wix Payments and PayPal, to process transactions securely.

  • Shipping Carriers: USPS, to fulfill and deliver your orders.

  • Tax Providers: Avalara, to calculate applicable sales tax based on your location.

  • Hosting/Platform: Wix.com, which hosts our Site and processes data pursuant to their privacy practices.

  • Dingo’s Den Sellers: Your name and shipping address are shared with third-party sellers to fulfill marketplace orders.

  • Legal Compliance: When required by law, subpoena, court order, or to protect our rights, property, or safety.

  • Business Transfers: In connection with a merger, acquisition, or sale of all or part of our assets.

4. Data Retention

We retain your personal information for as long as your account is active, as needed to provide services, or as required by law. Order records and transaction history are retained for a minimum of seven (7) years to comply with tax and accounting regulations. You may request deletion of your account and associated data by contacting us at info@saganswares.com, subject to our legal retention obligations.

5. Cookies and Tracking Technologies

Our Site uses cookies and similar technologies for essential site functionality (session management, shopping cart), analytics and performance measurement, personalization of content, and fraud prevention. You may control cookies through your browser settings. Disabling essential cookies may impair Site functionality. We do not respond to “Do Not Track” browser signals at this time.

6. Your Rights

6.1 All Users. You have the right to: access the personal information we hold about you, correct inaccurate personal information, request deletion of your personal information (subject to legal retention requirements), opt out of marketing communications at any time, and withdraw consent where processing is based on consent.

6.2 California Residents (CCPA/CPRA). If you are a California resident, you have additional rights under the California Consumer Privacy Act and the California Privacy Rights Act, including: the right to know what personal information we collect, use, and disclose; the right to delete personal information; the right to opt out of the sale or sharing of personal information (we do not sell personal information); the right to non-discrimination for exercising your privacy rights; and the right to correct inaccurate personal information. 6.3 Texas Residents. Under the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024, Texas residents have the right to: confirm whether we are processing your personal data, access your personal data, correct inaccuracies, delete personal data, obtain a portable copy of your data, and opt out of processing for targeted advertising, sale of personal data, or profiling. 7. Children’s Privacy

Our Site is not intended for individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected information from a child under 13, we will promptly delete it. We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information, including SSL/TLS encryption for data in transit, secure payment processing through PCI-DSS compliant providers (Wix Payments, PayPal), access controls limiting employee access to personal information, and regular monitoring for unauthorized access. No method of transmission or storage is 100% secure. We cannot guarantee absolute security but will notify affected individuals of any breach as required by applicable law.

 

9. Third-Party Links

Our Site may contain links to third-party websites, including animal rescue organizations. We are not responsible for the privacy practices of those sites. We encourage you to review their privacy policies before providing personal information.

 

10. International Users

Our Site is operated from the United States. If you access the Site from outside the U.S., your information will be transferred to and processed in the United States, where data protection laws may differ from your jurisdiction. By using the Site, you consent to such transfer and processing.
